General terms and conditions of sale

Article 1: Preamble

The present conditions of sale are concluded, on the one hand, by the company DUPRET-SPRL (whose head office is located at rue Andrifosse 12 4950 ROBERTVILLE) registered at the Banque Carrefour des Entreprises under the number 0 507,986,723 hereinafter referred to as "the seller" and, on the other hand, by any individual or legal entity wishing to make a purchase via the seller's Internet site, hereinafter referred to as "the buyer".

Article 2: Purpose

The present conditions of sale aim at defining the contractual relations between the salesman and the purchaser as well as the conditions applicable to any purchase carried out by the means of the site of the salesman, that the purchaser is professional or consumer.

The acquisition of a good or a service through the present site implies an acceptance without reserve by the buyer of the present conditions of sale.

These conditions of sale shall prevail over any other general or particular conditions not expressly approved by the seller.

The seller reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force at the date of the order by the buyer.

Article 3: Characteristics of the goods and services offered

The products and services offered are those listed in the catalog published on the seller's website.

Each product is accompanied by a description established by the supplier.

The photographs in the catalog are as accurate as possible but cannot ensure a perfect similarity with the product offered, especially with regard to colors.

These products and services are offered within the limits of available stocks. If, in spite of its efforts, all the articles or only a part are unavailable, the salesman informs the purchaser by email as soon as possible and offers to him the possibility of choosing between waiting or cancelling without expenses the order of the unavailable articles. The available articles will be delivered normally.

Article 4 : Rates

The prices of the products and services displayed on the site are indicated in euros including all taxes (VAT and other applicable taxes).

The seller reserves the right to modify its prices at any time. Nevertheless, the prices applicable to the order are those in force at the time of its confirmation.

The prices indicated do not include the costs of order processing, transport and delivery as long as they take place in the geographical areas indicated below.

Article 5: Geographic areas

The online sale of products and services presented on the site of the salesman is reserved for the purchasers who reside in EUROPE (EU) and for deliveries required in these geographical zones.

Article 6 : Orders

The buyer, who wishes to buy a product or a service must obligatorily :

  • Fill in the identification form with all the required information or give your customer number if you have one.

  • Fill in the online order form with all the references of the chosen products or services.

  • Validate your order after having checked it.

  • Make the payment in accordance with the conditions.

  • Confirm the order and payment. The confirmation of the order implies the acceptance of the present conditions of sale, the recognition of having a perfect knowledge of them and the renunciation to prevail itself of its own conditions of purchase or other conditions. All data provided and the recorded confirmation will be proof of the transaction. The confirmation will be worth signature and acceptance of the operations carried out. The seller will communicate by e-mail the confirmation of the registered order.

Article 7: Right of renunciation

According to the law, the consumer has the right to notify the seller that he/she renounces his/her purchase, without penalty and without giving any reason, within 14 working days from the day after the delivery of the product or the conclusion of the service contract.

This right of renunciation does not belong to the professional purchaser. Within this period, the consumer must notify his intention to renounce by e-mail and return, at his expense and risk, the product delivered to the administrative headquarters of DUPRET-SPRL Andrifosse 12 4950 Robertville Belgium.
Products must be returned in their original packaging, undamaged, with all accessories, the user manual and the original invoice/delivery note.

Products returned in this way must not have been unpacked, unsealed or used in any way. Incomplete, damaged or soiled goods by the customer will not be accepted.

Within 30 days after acceptance of the return of the goods, the seller undertakes to reimburse any payment made, with the exception of shipping costs. Unless otherwise agreed, the consumer cannot exercise the right of renunciation for contracts :

  • for the provision of services whose performance has begun with the consumer's consent before the end of the waiver period.

  • of supply of products made according to the specifications of the consumer or clearly personalized or which, because of their nature, cannot be forwarded or are likely to deteriorate or to expire quickly.

  • supply of audio or video recordings or computer software unsealed by the consumer.

  • supply of newspapers, periodicals or magazines.

Article 8: Payment terms

The payment is made by paypal. The ordered articles remain our exclusive property until the complete payment of the order by the buyer.

Article 9 : Deliveries

Deliveries are made to the address indicated on the order form, which can only be in the agreed geographical area.

The goods are transported at the risk of the seller until the goods are delivered to the delivery address specified by the buyer.

From that moment on, the buyer assumes the sole risk.

Delivery times are given as an indication only; if they exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed.

Article 10 : Guarantee

With respect to consumers, the seller guarantees the products it sells and the services it provides in accordance with the law of September 1, 2004 on consumer protection in the event of the sale of consumer goods (articles 1649 bis to 1649 octies of the Civil Code).

In case of non-conformity of a product sold found within 2 months of delivery of the goods, the consumer must notify the seller as soon as possible in a precise manner by registered letter or email.

This warranty only covers defects of conformity existing at the time of delivery of the goods.

Defects or damage due to misuse, such as water damage, oxidation, dropping or impact, neglect and wear and tear, are not covered by the warranty.

Similarly, repairs carried out by technicians not authorized by the supplier will result in the cancellation of the warranty.

The invoice or delivery note serves as a warranty document and must be retained by the consumer and produced in original. If the product is used for non-private purposes, the limited warranty conditions of the manufacturer/supplier apply.

Article 11 : Responsibility

The seller, in the process of selling online, is only bound by an obligation of means his responsibility can not be incurred for damage resulting from the use of the Internet such as data loss, intrusion, viruses, service failure, or other unintended problems.

The data on the site is given in good faith. The links to the websites of manufacturers and/or partners are provided for information purposes only.

The seller cannot be held responsible for information from these sites.

Article 12: Intellectual Property

All the elements of the site of the salesman are and remain the intellectual and exclusive property of this one.

No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, the elements of the site whether they are software, visual or sound.

Any simple link or hypertext link is strictly forbidden without the prior express written consent of the seller.

Article 13: Personal data

All personal data necessary for the processing of an order are kept by the seller or its employees and may be passed on to companies with which the seller - or its suppliers - collaborates, when such communication is necessary for the processing of the order.

The user also authorizes the seller to use this data to establish statistics in order to improve its site, the goods and the service it offers. This information may also be used to enable the dissemination, by any means of communication, of information relating to the seller's commercial activities to its customers.

Finally, the seller keeps the personal data to facilitate future orders.

The seller further undertakes not to disclose the information in its possession to any other company or firm

The data kept by the seller can be requested and corrected at any time upon request.

Article 14: Proof

The parties accept, within the framework of their relations, the electronic means of proof (as an example: email, computer backups, ...).

Article 15: Personalized objects

We can realize on request personalized objects, these objects remain the intellectual and graphic property of DUPRET-SPRL.

DUPRET-SPRL reserves the right to use, share and market these objects. It is possible to obtain these rights for a fee, a request by e-mail must be explicitly made and an offer will be made. In case of non-acceptance of this offer the objects will remain the intellectual and graphic property of DUPERT-SPRL.

Article 16: Dispute Resolution

The present online sales conditions are subject to Belgian law. In the event of a dispute, the courts of the seller's registered office shall have jurisdiction, except in the event of binding public policy provisions.
